Terms & Conditions
1.1 The following Terms and Conditions relate to all bookings made with local ground transportation companies (hereafter referred to as “Suppliers”) via Green Path Transfers Limited, either through the Green Path Transfers Limited website or any of its affiliate or subsidiary sites or any of its distribution partners. Green Path Transfers Limited acts solely as a booking agent for the Suppliers, and the contract covering provision of services is solely between you and the Supplier. Any additional booking conditions of the Supplier, regarding the contract between you and the Supplier, will be provided at the time of booking. As Green Path Transfers Limited is acting solely as the booking agent of the Supplier, it cannot be held liable or responsible for any issues or claims arising out of the provision of ground transportation services by the Supplier.
1.2 The registered office of Green Path Transfers Limited is Room 1206-7, 12/F, New Victory House, 93 Wing Lok Street, Central, Hong Kong and the company number is 1417932. It is strongly advised that you read these terms and conditions carefully, as they contain important information related to the rights, responsibilities and conditions of carriage that you will be bound by. If you do not agree to be legally bound by the terms and conditions of Green Path Transfers Limited, as well as any additional terms and conditions imposed by the Supplier you have entered into a contract with for provision of Transfer services, then you shall be disallowed from placing a booking through Green Path Transfers Limited.
1.3 In this Agreement, and unless the context otherwise requires:
- “You” or “Your” refers to all passengers for whom a booking has been made, whether named or not, including any added or substituted at a later date.
- “Supplier” or “Suppliers” refers to local ground transportation companies involved in the provision of services, for which Green Path Transfers Limited acts solely as a booking agent.
- “Us”, “Our” or “We” refers to Green Path Transfers Limited
- “Transfer” refers to the service provided by the local ground transportation company within the travel destination.
2.1 If more than one passenger is included in the booking, the person making the booking (the “Lead Party”) bears responsibility for all other passengers (the “Additional Party”) included in the booking, including any that are added or substituted at a later date. The Lead Party unconditionally accepts, on behalf of all the other members of the party, all of the terms and conditions of Green Path Transfers Limited and any additional terms and conditions of its Suppliers.
2.2 The Lead Party must be at least 18 years of age.
2.3 If the contract is made by an agent or 3rd party or any other party acting on behalf of the Lead Party, then that agent confirms that the Lead Party and the Additional Party unconditionally accept all of the terms and conditions of Green Path Transfers Limited and any additional terms and conditions of its Suppliers.
3.1 In order to place a booking, all the relevant instructions and processes must be followed on the booking website, including clicking the “Book Now” button in the check-out page.
3.2 All bookings must generally be placed at least 48 hours before departure. Some Suppliers may allow bookings with less than 48 hours notice.
3.3 Full payment is required at the time of the booking in order to confirm the booking. Upon receipt of payment, Green Path Transfers Limited will process the booking and issue, by email, a booking voucher. One voucher will be produced for the entire booking, including any return Transfers within the same booking. This voucher should be printed and carried by the Lead Party throughout the entire duration of any Transfer. It must be produced as proof of booking, if requested, by the Supplier and/or any of their agents or employees. This booking voucher should be checked for any inaccuracies as soon as you receive it, and it is your responsibility to inform us immediately of any errors to the booking.
3.4 We reserve the right to obtain verification that your credit/debit card is valid, and that you have funds available to cover the entire cost of the Transfer. If verification of the validity of the credit/debit card or the value of funds available cannot be achieved, we reserve the right to cancel your booking.
3.5 Green Path Transfers Limited reserves the right to refuse any booking for any reason of ours or our Suppliers. No guarantee is made as to the availability of the selected Transfer. If the Transfer you have booked is not available for any reason, a replacement Transfer or full refund will be offered. The replacement Transfer may have additional costs involved.
4.1 Errors, whether by Green Path Transfer Limited or by our Suppliers, can sometimes occur with regards to the prices presented on our websites. It is your responsibility to confirm the final price in the check-out page.
4.2 If the actual Transfer price is higher than that which has been confirmed in your booking, we will advise you of the error. You may choose to either confirm the booking by paying the additional amount, or to cancel the booking for a full refund.
4.3 Prices may vary based upon a number of factors, including but not limited to the date of booking, date of travel, number of passengers, destination, add-on services or vehicle type. As such, it is your responsibility to ensure that you are aware of the final price in the check-out page. Your acceptance of these terms and conditions implies consent to the final charge for the Transfer service presented in the check-out page.
4.4 Prices are quoted per vehicle, except in the case of shared Transfer services whereby the prices are quoted per passenger.
4.5 Acceptance of the final price provided in the check-out page, by clicking the “Book Now” button, invalidates any right to subsequently have your Transfer price determined by taximeter in the event of one being available in the Supplier’s vehicle.
5. Special Requests, Changes and Cancellations by You
5.1 Any special request should be specified at the time of booking. Reasonable requests will be communicated to the Supplier. Green Path Transfers Limited and our Suppliers will endeavour to fulfil every special request deemed reasonable, some of which may carry additional charges. However, we do not guarantee fulfilment of special requests, and neither Green Path Transfers Limited nor our Suppliers bear any liability to fulfil these requests.
5.2 Any changes to a confirmed booking should be communicated to us by email, to email@example.com. Green Path Transfers Limited and our Suppliers will endeavour to make any changes requested. However, we do not guarantee any changes to existing bookings, and neither Green Path Transfers Limited nor our Suppliers bear any liability to fulfil these requested changes. Furthermore, any changes will be subject to the individual policy of the Supplier, and may incur charges, including but not limited to any additional credit/debit card fees or charges, or foreign currency exchange rate variations.
5.3 Any cancellations of a confirmed booking should be communicated to us by email, to firstname.lastname@example.org. Any cancellation will be subject to the individual cancellation policy of the Supplier, and may incur charges, including but not limited to any additional credit/debit card fees or charges, or foreign currency exchange rate variations.
5.4 No refunds can be given on any no-shows or cancellations with less than 48 hours notification, and you will be charged the full price, unless stated otherwise in the Special Notes for Traveller section. Cancellations made with more than 48 hours notification may incur transaction fees and charges, including currency exchange losses.
6. Changes and Cancellations by the Supplier
6.1 If, for any reason, your confirmed booking is changed or cancelled by the Supplier, we will inform you of this as soon as reasonably possible. We will either attempt to provide an alternative Transfer service at no additional cost, or refund any monies paid. Neither Green Path Transfers Limited, nor our Suppliers, shall have any additional liability to you beyond this.
7. Luggage Allowance
7.1 The luggage allowance of each transfer is indicated in the search results. Generally, each passenger is allowed two pieces of luggage – one suitcase or large bag, measuring no larger than 70cms x 40 cms x 20cms, and one piece of hand luggage. Any excess or larger items, including but not limited to musical instruments, sporting equipment or oversized luggage, should be communicated to Green Path Transfers Limited before making a booking. Additional charges may be incurred. Only upon written acceptance from Green Path Transfers Limited of an allowance for any excess or oversized luggage, including confirmation of any additional charges, should a booking be made. Allowance for any excess or oversized luggage will only apply to the exact Transfer service it is requested for, including but not limited to the destination, date of travel, number of passengers and vehicle type of the Transfer, and acceptance is in no way transferrable to any other Transfer service. If no acceptance is received from Green Path Transfers Limited regarding additional or oversized luggage, the Supplier may refuse carriage of the excess or oversized items.
8. Conditions of Carriage
8.1 Green Path Transfers Limited accepts no liability for any failure of service or additional charges imposed by the Supplier if the Lead Party and/or the Additional Party are not in possession of the booking voucher required for travel at the time of the Transfer.
8.2 The contracted Supplier reserves the right to refuse Transfer services to any passenger, whether the Lead Party and/or the Additional Party, if the passenger is, or is suspected to be, under the influence of alcohol or illegal drugs, or is any way aggressive or violent.
8.3 Consuming alcohol, eating and smoking is forbidden on all Supplier vehicles unless expressly agreed to by the Supplier at the time of the Transfer service.
8.4 Although all reasonable efforts shall be taken by the Supplier, neither the Supplier nor Green Path Transfers Limited provide any guarantee of any Transfer service arriving or departing at a specific time, and neither Green Path Transfers Limited nor the Supplier bear any liability in the event of any delay.
8.5 Although all reasonable efforts shall be taken by the Supplier to be aware of any flight delays or diversions, it is the responsibility of the Lead Party to advise the Supplier of any delays or diversions, if possible. Green Path Transfers Limited accepts no liability for any additional charges that may be levied by the Supplier in the case of flight delays or diversions.
8.6 Green Path Transfers Limited is not liable for any changes made by the Supplier to the exact route, pick up point or drop off point of a specific Transfer service.
9.1 Green Path Transfers Limited has a liability to use defined guidelines to recruit and approve Suppliers. However, Green Path Transfers Limited has absolutely no liability whatsoever with regards to the actual provision of the Transfer services by the Supplier.
9.2 Green Path Transfers Limited, and each of our group companies, subsidiaries and employees, by acting as simply agents for the Supplier, excludes all responsibility and liability for all and any kind or amount of losses or damages that may be incurred by the Lead Party or the Additional Party in relation to the Transfer services provided by the Supplier.
9.3 Green Path Transfers Limited, and each of our group companies, subsidiaries and employees, by acting as simply an agent for the Suppliers, exclude all responsibility and liability for all and any kind or amount of accident, injury or death that may be incurred by the Lead Party or the Additional Party in relation to the Transfer services provided by the Supplier.
9.4 Green Path Transfers Limited, and the Supplier, bear no liability for any loss, theft or damage to any luggage, that may be incurred during operation of the Transfer service.
9.5 Green Path Transfers Limited, and the Supplier, are not liable for any Force Majeure Events, or for any losses, damages, personal injury or death as a result of any Force Majeure Events. The following are deemed to be Force Majeure Events:
- compliance with police requests
- the acts, decrees, legislation, regulations or restriction of any government
- deaths and accidents on the road, vehicular or otherwise
- traffic delays or road closures
- strikes, lock-outs or other industrial action
- issues or problems caused by customers
- properties that are not accessible to type of service booked
- impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport
- fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster
- civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war
9.6 Our terms and conditions, and your use of this web site, are bound and governed by the laws of Hong Kong, and in the event of any dispute, you agree to accept the exclusive jurisdiction of the Hong Kong courts.
10.1 If you experience any difficulty or issue during your holiday, you should raise it with the Supplier who has provided the Transfer service. Contact details of the Supplier are supplied in your Booking Voucher.
10.2 We consider Travel Insurance to be essential, and would strongly advise that the Lead Party and Additional Party have an appropriate level of insurance to cover against events including, but not limited to, trip cancellation, luggage loss or damage, accident, personal injury or death.
10.3 These terms and conditions replace all previous terms and conditions previously applicable to Green Path Transfers Limited, use of our website and/or sale of the Transfer services on behalf of our Suppliers, whether through one of our websites, or any distribution or affiliate partners.
